EMI going after Beatles-Beach Boys mashup producer

A DJ who has compiled a "mashup" recording combining the Beatles' Sgt. Pepper's Lonely Hearts Club Band with the Beach Boys' Pet Sounds has been threatened with a multi-million dollar lawsuit by the groups' label.

D-silence.com reported that EMI records, which owns the exclusive copyrights to both the albums, has issued a cease-and-desist order against DJ-producer Clayton Counts, who compiled the Sgt. Petsounds project using the name the Beachles. The album, which was created for Counts' friends, was not sold commercially, but was available for free download on his site.

According to the order which Counts posted in its entirety on his website (claytoncounts.com/blog/the-beachles), EMI is not only asking for the project to be removed, but is seeking, quote, "the dates on which those recordings were streamed and/or downloaded; the number of times those recordings were streamed and/or downloaded; and any and all available information regarding persons who streamed and/or downloaded those recordings."

It's not clear whether EMI is planning to file suits against the individual downloaders of the album.

Counts posted a tongue-in cheek message to fans on his site, saying, "I hope Paul (McCartney) and Brian (Wilson) come to my rescue now, 'cause I haven't got a dime for these guys to take. I've been struggling as an artist for years, putting most of what little money I've had into recording my own music. The Beachles are still out there, though. If you want to break the law, check 'em out. They've threatened to sue me big time."

On recent years, EMI has threatened similar suits against DJ Danger Mouse for The Grey Album, which combined The Beatles, or "The White Album," with rapper Jay-Z's Black Album, and against djBC for his Beastles mashup, which mixed the "Fab Four" with the Beastie Boys.

Paul McCartney has stated numerous times that the Beach Boys' 1966 Pet Sounds album was the direct inspiration for the Beatles Sgt. Pepper's Lonely Hearts Club Band which was released the following year.

The track-for-track combination of the albums resulted in an amusing list of titles:
