Nickelback frontman gives up drunk driving appeal

Nickelback frontman Chad Kroeger has abandoned his attempt to appeal a conviction for a three-year-old drunk driving charge. According to the Canadian Press, a similar appeal on constitutional grounds in another case was overturned, making it virtually impossible that Kroeger could get his conviction thrown out on the same grounds. Kroeger's lawyer, Marvin Stern, said on Thursday (February 5th), "At the time of the trial we felt that his rights had been violated. The state of the law has now changed and we respect the current state of the law and are bound by it and in law there's no ground of appeal left."

Kroeger was stopped for speeding in the early morning hours of June 22nd, 2006, in British Columbia. He was charged with impaired driving and driving with a blood-alcohol level over .08, almost twice the legal limit.

The impaired driving charge was dismissed, but not the blood-alcohol charge.

Making his case to dismiss all charges, Kroeger's lawyer argued that the singer's constitutional rights were violated when a police officer asked him to blow into his face after detecting the smell of alcohol.

The judge allowed the evidence, saying he felt it was obtained legally.

Kroeger was given a one-year ban on driving and a $600 fine.
